Senior Vice President Commercial Contracts (UAE National Only) - ( 19000056 )


Job Purpose

1 Lead the end-to-end tendering process, from RFP development review till the appointment of consultant or contractor

2 Manage the contractor pre qualification , completion of tender documents, bid evaluations, finalizing contract documents, contract controls and contract administration

3 Manage claims, VOs, bonds, warranties, accounts and close out documentation

4 Evaluate the compliance with contractual terms, DoA and P&Ps

Roles and Responsibilities


Lead the tendering process from planning & prequalification until award, ensure it is implemented as per the procurement policy and procedures

Approve tender-related scope templates (consultants and contractors) and associated documentation to comply with latest Laws, regulations, Policy & Procedures, and liaise with Legal and Finance Departments

Functionally review project scope received from PMC or other Users (eg, Development Management) and liaise with the Users to develop and maintain scopes of work samples for issue in RFPs

Ensure Support is extended to Development and Project management teams in preparation of Project Procurement Strategies (and packages)

Ensure the tendering process for cost recoverable assets abide by the relevant authorities guidelines and standards

Review submissions and approve prequalification and technical evaluation criteria and ensure that these are in line with Company standards

Review short-listed bidders identified by User & Vendor-list Prequalification and obtain Expression of Interest

Liaise with the Users to arrange for site visits and pre-bid meetings

Coordinate and participate in tender opening of technical and commercial proposals

Liaise with Project management teams (and PMC) and other Users for bid technical clarification requestsevaluation and Perform clarification requestscommercial evaluation for bids of technically acceptable bidders

Seek assistance from Cost Estimation and project teams and PMC (if required) to evaluate bidders or sub-contractors priced proposals (quotations) for tenders

Support Users on technical negotiations and lead commercial negotiations with bidders to secure the most competitive offers that provide the Company with the best value for money without risk exposure

Contract variation approval process

Lead the development and maintaining contract related forms templates and checklist linked to automated filing systems for easy retrieval, and to satisfy Legal and Audit requirements

Provide timely administrative support and contractual advice for all contract management activities such as contract termination, suspension, claims, variations, close-outs and extensions

Assist Cost Estimation and cost control in processing payments by providing required contractual advice

Contract Administration Management

Identify breaches in contract delivery

- Solicit feedback from end users (Project Managers) to identify breaches

- Perform root cause analysis to identify source of breach and recommended action

Coordinate and followup with vendors and Project Managers to ensure seamless execution of contractsscope of work

- If required by stakeholders, report contractor contractual adherence to Project Managers accurately and in time for required actions

- Help stakeholders in resolving issues in case of any schedule delays or contractual disputes

Ensure all contractual changes are tracked and documented by variation orders

lead end-to-end Variation Order process as follows

- Review recommendation on Variation Orders to management for approval

- Liaise with Development Management, Project Management and Project Controls

- Gather input from Cost Estimation to estimate the cost impact of the Variation Orders and ensure that it has been considered

Perform any additional related tasksactivities as directed by the Director Commercial Contracts

Working Conditions

Min of 12 years of experience


Min of 4 years of managerial experience heading a tendering and commercial contracts function


Tendering and Contract administration preferably with a large real estate company with annual revenue of at least AED 2 billion


Demonstrated expertise in contract administration and dispute resolution
Specific knowledge of FIDIC contract terms, local laws and other forms of contracts
High ethics that lend to managing an unbiased contract administration process
Enforcing standards, procedures, policies and contractual agreements
Attention to detail for monitoring contract delivery
Excellent communication skills (verbal, written) for drafting & maintaining contracts
Building and maintaining relationships with PMs, supplierscontractorsconsultants


Bachelor degree in engineering or contract management, Masters preferred
Formal contractual dispute resolution training is highly preferred
